BOOKING TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before booking any tour, experience or charter with Epic Escapes Yacht ("the Company", "Epic Escapes Yacht" or "we/us"). This booking confirmation automatically activates the terms detailed below, as published on our rate sheet and website. By booking a tour, experience or charter, you (the "Charterer", "Client" or group leader) confirm that you have read, understood and accepted these terms in full, both on your own behalf and on behalf of all passengers and guests in your group.

1. NATURE OF THE SERVICE — EPIC ESCAPES YACHT AS INTERMEDIARY AND BOOKING AGENT

Epic Escapes Yacht is a tourism services company dedicated to organizing, marketing and coordinating luxury nautical experiences (yacht, catamaran and similar vessel tours) in the Riviera Maya and Cancún. Epic Escapes Yacht DOES NOT OWN the vessels used to provide these tours or experiences. All vessels are provided, operated and crewed by independent third parties — owners, shipping companies and/or subcontracted providers (the "Vessel Operator") — who maintain their own crew, navigation permits, licenses, maintenance and insurance policies.

Accordingly, the Client expressly acknowledges and accepts the following:

  • Epic Escapes Yacht acts exclusively as a booking agent, organizer and intermediary between the Client and the Vessel Operator, and as the point of contact and logistical coordinator before, during and after the tour.

  • Responsibility for the vessel's physical and mechanical condition, maintenance, seaworthiness, safety equipment, operation, crew, captaincy and navigation rests exclusively, directly and entirely with the subcontracted Vessel Operator, and not with Epic Escapes Yacht.

  • Any public liability, protection and indemnity ("P&I") insurance policy, passenger accident coverage, or any other marine coverage applicable to the vessel, its crew and its occupants is contracted, maintained and administered by the Vessel Operator — not by Epic Escapes Yacht.

  • Any claim relating to property damage, injury, death, loss of belongings, mechanical failure, vessel condition, or crew negligence during navigation must be directed in the first instance against the Vessel Operator and its insurer, as they are the parties directly responsible to the Client for such matters.

  • Epic Escapes Yacht makes reasonable efforts to work only with Vessel Operators that hold valid permits from the competent maritime authority (Secretaría de Marina / Port Captaincy) and valid insurance, but does not guarantee, endorse, or assume joint or subsidiary liability for the non-compliance, negligence or conduct of such Operators or their crew.

  • Epic Escapes Yacht's liability is limited exclusively to the proper handling of the booking, payment processing, logistical coordination, customer service, and communication of information provided by the Vessel Operator.

2. RESERVATION

Your contract for coordination and intermediation services is with Epic Escapes Yacht; the nautical transportation and onboard hospitality service is provided by the Vessel Operator assigned to your tour or experience. The Charterer will be responsible for the full cost of the tour or experience, including any cancellation or modification charges under these terms. The booking is formalized once Epic Escapes Yacht confirms availability in writing (email or WhatsApp) and issues the corresponding confirmation/invoice. The Client must carefully review the details of the confirmation to ensure the date, time, vessel type, number of passengers and requested add-ons are correct, and must notify Epic Escapes Yacht immediately of any discrepancy. Epic Escapes Yacht may delegate the execution of any part of this agreement, including the nautical service itself, to Vessel Operators, as well as to its affiliates, employees and/or agents.

3. PAYMENT TERMS

A credit card must be registered as a guarantee at the time of booking. A 50% deposit of the total tour or experience cost is required at booking and will be charged as soon as the reservation is confirmed (this process may take up to 12 hours). The deposit amount may vary depending on the type of tour, experience or season. The remaining balance will be charged 24 hours before boarding time, except for cash payments, which must be settled before boarding. Any applicable Marina Fee Tax will be collected in cash prior to boarding.

4. CANCELLATION TERMS

Weather-related or force majeure cancellations

Cancellations due to weather conditions or force majeure are at the sole discretion of the Vessel Operator and/or the competent port authority (Port Captaincy), and will be communicated to the Charterer by Epic Escapes Yacht via email, phone or WhatsApp before the tour begins. If the tour is cancelled for this reason and no rescheduling date can be found, Epic Escapes Yacht will arrange a full refund of any deposit paid by the Charterer.

Cancellation by Epic Escapes Yacht or the Vessel Operator

Epic Escapes Yacht reserves the right to cancel a tour or experience (including due to the unavailability of the assigned Vessel Operator), which will be communicated to the Charterer before the tour begins. In such case, Epic Escapes Yacht will issue a full refund of the deposit paid, or offer a substitute vessel of equivalent category, at the Client's reasonable choice.

Cancellation by the Client

Any change of date, destination or vessel type requested by the Charterer will be considered a cancellation subject to the conditions below. If any scheduled payment is not received by the payment deadline, Epic Escapes Yacht reserves the right to cancel the booking and retain all deposits and charges paid to date.

  • Up to 20 days before the tour: 70% refund of the total amount paid.

  • 15 to 19 days before the tour: 55% refund of the deposit or total amount paid.

  • Less than 15 days before the tour: non-refundable.

5. VESSEL DELIVERY AND BOARDING

The Vessel Operator will make the vessel available at the specified boarding point, on the agreed date and time, fully operational and ready for service. The Charterer and group are encouraged to review the safety equipment available on board before departure. Acceptance of boarding by the Charterer certifies that the vessel's condition was deemed satisfactory at the time of boarding. If, due to causes attributable to the Vessel Operator, delivery cannot be made within a reasonable period (up to 24 hours) of the specified time, and no substitute vessel can be offered, the Charterer may cancel the booking and Epic Escapes Yacht will refund the full amount paid. If the Charterer or group fails to show up or is not ready to board at the agreed time, neither Epic Escapes Yacht nor the Vessel Operator will be liable for any resulting reduction in tour time nor obligated to issue a refund, without prejudice to the possibility of rescheduling the departure time within the same day, subject to availability.

6. ACCIDENTAL DAMAGE, DEATH & INJURY

The use or consumption of illegal drugs is strictly prohibited on board the vessels or at facilities used by Epic Escapes Yacht. The consumption of alcohol may increase the risk of injury around water and vessels, a risk which the Charterer and their guests voluntarily accept by participating in the tour. Neither Epic Escapes Yacht nor the Vessel Operator shall be liable for claims of property damage, personal injury or death arising directly or indirectly from the consumption of alcohol or drugs by the Charterer or their guests, even if such damage was caused in part by crew negligence. This does not limit or diminish the Vessel Operator's liability for its own negligence in cases that do not arise, directly or indirectly, from alcohol or drug consumption by the affected passenger.

The Charterer acknowledges that nautical activities carry inherent risks (waves, sea conditions, marine wildlife, slippery surfaces, vessel movement, among others) that cannot be entirely eliminated, and that they participate in the tour voluntarily and at their own discretion.

7. SKIN DIVING & SWIMMING

Neither Epic Escapes Yacht, the Vessel Operator, nor the applicable insurance underwriters shall be liable for accidents, injuries or death resulting from swimming, snorkeling, diving or the use of related equipment (masks, fins, snorkels, scuba gear), except where such activities are directly guided by crew members and the incident results from proven negligence of that crew member.

8. ADDITIONAL EXPENSES

The Charterer agrees to cover any additional expenses not included in the contracted package that arise during the tour, including but not limited to: food and beverages beyond the package, extra fuel for route extensions requested by the Client, marina or port fees, special permits, and additional supplies requested by the Charterer or their group.

Neither Epic Escapes Yacht nor the Vessel Operator shall be liable for any loss the Client may suffer as a result of an insurer refusing coverage due to incorrect information provided by the Client, or due to the Client's own negligence, willful default or misconduct. Should damage or loss to the vessel or its equipment result from failure to follow crew instructions, the Charterer will be liable for the full cost of repair or replacement. Adults will at all times be responsible for any minors in their charge during the tour.

9. INSURANCE

The Vessel Operator maintains, at its own expense and under its own arrangement, such public liability and marine insurance coverage for the vessel and its occupants as it deems appropriate. Such policy does not necessarily cover loss of life (except through the Vessel Operator's proven negligence) or damage to or loss of personal property of any person on board, so the Client is advised to obtain their own travel or personal accident insurance prior to the tour. Epic Escapes Yacht may, upon request, share contact information for the Vessel Operator or its insurer for informational purposes, without this implying any liability on the part of Epic Escapes Yacht regarding such coverage.

10. RESTRICTED USE AND ONBOARD CONDUCT

The vessel shall be used exclusively as a pleasure vessel for the Charterer, their family and guests, for the duration of the contracted tour, and shall not be used at any time to transport unregistered passengers, cargo, or engage in any unauthorized commercial activity by the Client. The Charterer and their group agree to follow the captain's and crew's instructions at all times, as well as applicable Mexican law. Rafting to another vessel without crew authorization is prohibited, as is night navigation outside hours authorized by the port authority.

11. FOOD AND BEVERAGES

Consuming raw or undercooked meat, poultry, seafood, shellfish or eggs may increase the risk of foodborne illness, especially if you have certain medical conditions. Clients are encouraged to inform us in advance of any food allergies or dietary restrictions.

12. LIMITATION OF LIABILITY AND INDEMNIFICATION

It is understood and agreed that Epic Escapes Yacht acts as an intermediary and booking agent on behalf of the Vessel Operator, and not as the owner, operator or carrier of the vessel. Neither Epic Escapes Yacht nor its employees, officers or agents shall be liable to any person for loss, damage, injury or death resulting from use of the vessel, except where such damage arises directly from a negligent act or omission of Epic Escapes Yacht itself in its role as coordinator and intermediary (for example, a booking error, a billing error, or failure to communicate essential information), and not from the operation, condition, crew or navigation of the vessel, which remains the exclusive responsibility of the Vessel Operator.

Epic Escapes Yacht makes no representations beyond those contained in these Terms and Conditions, its website, and the booking materials provided. Epic Escapes Yacht shall not be liable for any charges, expenses, airfare, lodging, meals, phone calls or other expenses incurred by the Client for any reason related to the tour.

The Charterer agrees to indemnify and hold harmless Epic Escapes Yacht, its employees, officers and agents from any claim for loss of or damage to property, or personal injury (including loss of life) resulting from the use, operation of, or participation in the tour by the Charterer or any member of their group, as well as any claim for loss of or damage to the personal property of the Charterer or their guests brought on board the vessel, except in cases of direct and proven negligence by Epic Escapes Yacht in its role as intermediary.

13. GOVERNING LAW AND JURISDICTION

This Agreement shall be interpreted and governed in accordance with the applicable laws of the State of Quintana Roo, Mexico, and the parties submit to the jurisdiction of the competent courts of that State, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
