Liability Waiver and Release of Responsibility

By booking any charter, tour, or experience with Epic Escaped Yacht (whether directly through our website or via third-party platforms such as TripAdvisor, GetYourGuide, or others), you acknowledge and agree to the following:

1. Assumption of Risk

Participation in any yacht charter or water-based activity involves inherent risks, including but not limited to accidents, injuries, drowning, seasickness, property damage, theft, or other unforeseen events. By booking, you voluntarily assume all such risks and agree to participate at your own responsibility.

2. Release of Liability

Epic Escaped Yacht, its owners, captains, crew members, employees, and affiliates shall not be held liable for any accident, injury, loss, damage, illness, delay, or expense of any kind that occurs during or as a result of your participation in any of our charters or activities.

3. Personal Responsibility

All guests are responsible for their personal safety and belongings while on board. Epic Escaped Yacht is not responsible for lost or damaged items. We highly recommend obtaining personal travel or medical insurance that covers boating and water-related activities.

4. Alcohol Consumption

Alcoholic beverages may be served during your charter. Guests must be of legal drinking age (18 or 21 depending on local jurisdiction). Consumption of alcohol is entirely at your own discretion and risk. Epic Escaped Yacht assumes no responsibility for incidents resulting from alcohol consumption during or after the experience.

5. Health and Medical Conditions

Guests must disclose any medical conditions, allergies, or physical limitations that may affect their ability to safely participate. Epic Escaped Yacht is not responsible for medical incidents, allergic reactions, or complications that arise during the charter.

6. Right to Refuse Service

For safety reasons, we reserve the right to deny boarding or remove any guest who appears intoxicated, disruptive, or poses a risk to themselves or others. In such cases, no refund will be issued.

7. Weather and Sea Conditions

Yacht charters are subject to weather and sea conditions. Epic Escaped Yacht reserves the right to cancel, reschedule, or modify a trip due to unsafe conditions, technical issues, or government advisories. Safety will always be our top priority.

8. Force Majeure

Epic Escaped Yacht will not be held responsible for cancellations, delays, or changes caused by events beyond our control, including but not limited to weather conditions, mechanical failures, natural disasters, government restrictions, or other force majeure events.

9. Transportation

If ground transportation is provided as part of your experience, Epic Escaped Yacht is not responsible for accidents, delays, or incidents that occur during transit.

10. Cancellation and Modification Policy

All bookings are non-refundable within 48 hours of the scheduled charter. Cancellations made more than 48 hours in advance may be rescheduled based on availability but are subject to administrative fees. No refunds or reschedules will be granted for no-shows or same-day cancellations.

11. Third-Party Bookings

If your reservation is made through an external platform (TripAdvisor, GetYourGuide, etc.), these Terms and Conditions still apply and are binding upon confirmation of your booking.

12. Governing Law and Jurisdiction

All disputes shall be governed by and interpreted in accordance with the laws of Mexico, with exclusive jurisdiction in the courts of Quintana Roo.

13. Acceptance of Terms

By completing your booking, you confirm that you have read, understood, and accepted these Terms and Conditions, including the Liability Waiver and Release of Responsibility. Completion of a reservation shall be considered sufficient proof of acceptance, even without a physical signature.
